Terms of Service

These terms set out the conditions for using the app “myupuri” (the “Service”) provided by NEVELL Inc. (“we”). Please use the Service only if you agree to them.

1. Scope

These terms apply to every relationship between us and anyone who uses the Service.

Notices and instructions we show inside the app or on this website form part of these terms.

2. Accounts

The Service is invite-only. You need an account, and you need an invite code to create one.

• People under 13 may not use the Service. We ask for your date of birth when you sign up.
• If you are under 18, please use the Service with the consent of a parent or guardian.
• An account is for one person. Do not lend or transfer it.
• Keep your sign-in details (Apple, Google, LINE, email) to yourself.
• There is a limit on how many people one person can invite (currently three).

3. What the Service does

When two users bring their phones close together, both cameras shoot at the same moment and the photos are combined into a single strip image.

Photos and videos are currently stored on each user’s own device. They are not uploaded to our servers.

4. What you must not do

You must not:

• photograph someone without their consent, or publish or distribute a photo without the consent of everyone in it;
• take or share obscene images, images that hurt others, or images that infringe someone’s rights;
• impersonate another person, or misstate your age when signing up;
• sell invite codes or hand them out to the public;
• analyse or modify the Service, gain unauthorised access, or send automated bulk requests;
• break the law or public order, or infringe our rights or those of a third party.

5. Rights in photos

• Rights in a photo or video belong to the user who took it.
• By shooting together, you each allow the other to keep that photo on their device and use it for personal enjoyment.
• Get the consent of everyone in the photo before posting it on social media.

6. Paid features

• The core of the Service is free. Some decorations, such as frames, can be bought as in-app purchases.
• Payments are handled by the App Store or Google Play, and cancellations and refunds follow each store’s rules.
• Because these are digital goods, we cannot accept returns or exchanges after purchase.

7. Changes and interruptions

We may change the Service, or stop providing it, without prior notice.

We are not liable for damage caused by this, except where we acted intentionally or with gross negligence.

8. Suspension and deletion of accounts

If you breach these terms we may suspend or delete your account without notice.

You can delete your account at any time from “Me” in the app (Deleting your account).

9. Disclaimer

• We do not warrant that the Service fits your particular purpose, or that it has the functions, accuracy or usefulness you expect.
• We are not responsible for disputes between users, including disputes about photos. Please resolve them between yourselves.
• Where we are liable, our liability is limited to the amount you paid us in the previous 12 months.

10. Governing law and jurisdiction

These terms are governed by the law of Japan.

The court with jurisdiction over our head office has exclusive jurisdiction of first instance over any dispute about the Service.
